Terms of Use
These Terms of Use ("Terms") apply to your use of the Trabit app for iPhone, iPad, and Apple Watch (the "App") and the website trabit.app (the "Website"), both provided by Trabit ("we", "us", or "our"). By downloading or using the App or the Website, you agree to these Terms. If you do not agree, do not use them.
1. Relationship to Apple's terms
The App is licensed to you under Apple's Licensed Application End User License Agreement (the "Standard EULA"). These Terms supplement the Standard EULA. If they conflict, the Standard EULA governs to the extent required. Apple is not a party to these Terms and is not responsible for the App or its content.
2. Not medical advice
The App provides general information about habits, fitness, sleep, and nutrition for personal tracking and motivation. It is not a medical device and does not provide medical advice, diagnosis, or treatment.
- Coach suggestions, training adjustments, readiness scores, and dinner ideas are general guidance only. They are not tailored medical, nutritional, or clinical recommendations.
- Always consult a qualified healthcare professional before starting or changing an exercise, diet, or sleep routine, especially if you have a medical condition, injury, allergy, or are pregnant.
- Stop exercising and seek medical help if you feel pain, dizziness, shortness of breath, or other symptoms.
- Never ignore or delay professional advice because of something you saw in the App.
- If you think you may have a medical emergency, contact your local emergency services immediately.
3. Estimates and generated content
Some features produce estimates or generated text, including meal estimates of protein and calories, receipt, fridge, and pantry scanning, natural language logging, training plan changes, weather-based suggestions, and coach replies. These are produced automatically, may be inaccurate or incomplete, and should be checked before you rely on them. Recipe and dinner suggestions do not account for allergies or dietary restrictions unless you verify the ingredients yourself. You are responsible for the decisions you make based on the App.
4. Your data and your account
Your data is stored on your device and in your own iCloud account, as described in our Privacy Policy. You are responsible for keeping your device and Apple Account secure and for backing up your data. We are not responsible for data lost through device loss, iCloud issues, or deletion.
5. Social features
If you use friend features, you are responsible for what you share, including your display name and goal names. Do not use names or content that are unlawful, offensive, impersonate others, or infringe others' rights. We may remove shared content or restrict access to social features if these Terms are breached.
6. Acceptable use
You agree not to misuse the App or the Website, including by attempting to reverse engineer, disrupt, or gain unauthorised access to them or to other users' data, or by using them for any unlawful purpose.
7. Beta versions
Pre-release versions distributed through TestFlight are provided for testing. They may contain errors, change without notice, or stop working, and data created in them may be lost.
8. Price and donations
The App is free. It may include an optional donation link. Donations are voluntary, do not unlock any features, and are processed by PayPal under its own terms. Except where required by law, donations are not refundable.
9. Intellectual property
The App, the Website, and their content, design, and trademarks are owned by Trabit or its licensors. These Terms do not grant you any rights to them beyond the licence to use the App under the Standard EULA. Apple, Apple Watch, Apple Health, iCloud, and Siri are trademarks of Apple Inc.
10. Disclaimer of warranties
To the fullest extent permitted by law, the App and the Website are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted or error-free, that estimates or suggestions will be accurate, or that using the App will produce any particular health or fitness result.
11. Limitation of liability
To the fullest extent permitted by law, Trabit will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any injury, illness, loss of data, or loss of profits, arising from or related to your use of, or inability to use, the App or the Website, including any reliance on suggestions, estimates, or other content. Our total liability for any claim relating to the App or the Website will not exceed the greater of the amount you paid for the App in the twelve months before the claim, or USD 50.
Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
12. Indemnity
To the extent permitted by law, you agree to indemnify and hold Trabit harmless from claims arising from your breach of these Terms or your misuse of the App or the Website.
13. Changes and termination
We may change, suspend, or discontinue any part of the App or the Website at any time. We may update these Terms, and the effective date above shows when they last changed. Continuing to use the App after an update means you accept the updated Terms. You can stop using the App at any time by deleting it.
